What Every Las Vegas Landlord Must Provide Per Nevada Laws

Nevada Revised Statute, Chapter 118A - the Landlord and Tenant laws, is the dominant law that defines the legal relationship between all Nevada tenants and their relationship to Nevada landlords. All Las Vegas Landlords have a legal obligation to adhere to N.R.S. 118A. Before signing any renatl lease, rental contract, or lease agreement, it is the responsibility for Las Vegas rooommates to inspect the premises and make sure the prospective landlaord provides at leas tht minimum services..

Las Vegas landlord are required by N.R.S. 118A to to supply heat, air-conditioning, running water, hot water, electricity, gas, or another essential service. As long as the landlord provides such required essential services, the tenant must pay the required rent.

Currently, the average rental price for apartments in Las Vegas, NV is $1,341 for 892 sq. ft.. That works out to about $1.50 per square foot.

What Remedies Are Available to a Las Vegas Roommate/Tenant for Failures of Landlord

If the Las Vegas landlord willfully or negligently fails to provide all required and essential services, and thereby causes the premises to become unfit for habitation, the the Las Vegas roommate or tenant shall give written notice to the Las Vegas landlord specifying the details of the breach. The Las Vegas roommate or tenant must be very sepcific; e.g., no hotwater; no working toilet; etc.

If the Las Vegas landlord does not adequately remedy the breach, or repair or fix the essential services, or at least make a decent effort to do so within 48 hours, except a Saturday, Sunday or legal holiday, after it is received by the landlord, the tenant may, take the following steps against the Las Vegas landlord.

  1. Pursue and acquire reasonable amounts of such essential services during the landlord's noncompliance and deduct their actual and reasonable cost from the rent;
  2. Recover actual damages form the Las Vegas Landlord, including damages based upon the lack of use of the premises or the diminution of the fair rental value of the dwelling unit;
  3. Withhold any rent that becomes due the Las Vegas Landlord during the landlord's noncompliance without incurring late fees, charges for notice or any other charge or fee authorized by this chapter or the rental agreement, until the landlord has attempted in good faith to restore the essential services; or
  4. Pursue and acquire other housing which is comparable during the Las Vegas landlord's noncompliance, and the rent for the original premises fully abates during this period. The Las Vegas roommate may recover the actual and reasonable cost of that other housing which is in excess of the amount of rent which is abated.
